Driving on the roads can always bring a level of risk, but what do you do when cars suddenly start doing doughnuts in the middle of an intersection and a crowd of people are cheering them on? Street takeovers are adrenaline fueled spectacles that are gaining traction all over social media due to the daring stunts and spontaneous nature.

While at first glance, this show of adrenaline may seem appealing and interesting, however, these takeovers are actually causing more damage than what some people realize. However, by understanding the legal implications of street takeovers, you would be able to make the right decision without crossing any lines.

    What Is a Street Takeover?

A street takeover or sometimes referred to as a ‘sideshow’, is an informal car gathering where people occupy an intersection to perform a variety of automotive stunts such as drifting, donuts, and ghostriding. These gatherings typically start off with drivers and spectators abruptly blocking off an intersection and when there is enough space, drivers would begin performing stunts either in tandem or by turns as spectators arrive and cheer on.

However in some recent takeovers, spectators have been incorporating additional reckless acts during the driver’s stunt such as setting off fireworks, lighting a portion of the street or an object on fire, or even standing in the middle of the intersection as drivers do donuts. As these gatherings get larger and more chaotic, there are a number of things that get out of control such as spectators sustaining serious injuries, extensive property damage and a litany of noise complaints.

What Is the Purpose of a Street Takeover?

While the main purpose of street takeovers has yet to be determined, some analysts determine that these gatherings serve as a means of providing those in car culture a way to show off or to  rebel against the status quo. Meanwhile for spectators, their participation can be summed up either as a way to support the drivers or to witness it for pure curiosity. However, it is important to note that even as a spectator, you can potentially face charges for helping the takeover to continue.

Why Don’t Cops Stop Street Takeovers?

While local law enforcement try their best to stop these gatherings from occurring, the congested nature of these street takeovers makes it incredibly difficult for officers to find and arrest the organizers and participants. As officers are slowed down either due to being stuck in traffic or spectators blocking their path to take control of the situation, single unit patrols and officers are overwhelmed by the situation and cannot catch those responsible who are fleeing the scene.

What Are the Charges for Street Takeovers?

According to California Vehicle Code 23103, any driver caught participating in a street takeover will be charged with reckless driving, which is punishable by imprisonment in county jail for 90 days and a fine up to $1000. However, if drivers cause any property damage during the street takeover or intentionally try to evade the police, then additional charges will be added on and their license will be suspended and possibly be taken away.

For spectators and drivers who intentionally block traffic and any attempts for officers to arrive on the scene, they can potentially be charged with a variety of violations and fines as per California Vehicle Code 22400. In addition, any acts of vandalism and violence will be added on to their charges and depending on the severity and scale of the damage, the responsible party will face significant jail time, fines, and lawsuits.

What to Do if You Have Been Injured in a Street Takeover?

If you have been injured in a street takeover, it is vital that you seek immediate medical attention to make sure you don’t develop any long-term health complications. As street takeover accidents happen during the heat of the moment, it may be difficult to find those responsible especially if they have suddenly driven away from the scene. With that in mind, it is important that you hire an experienced personal injury attorney who can help find those responsible and hold them accountable for their actions.
