Liability In Left-Turn Accidents
Drivers have a responsibility to keep an eye out for pedestrians and yield the right of way to pedestrians that are lawfully in a marked crosswalk. Drivers that hit a pedestrian while turning left will typically be found at fault. According to California Vehicle Code 21801, “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.”
Most pedestrian accidents tend to take place in the early morning hours and between 6:00 p.m. – 9:00 p.m. Drivers should be extra cautious during this time. The family of a victim that dies in a car accident is able to seek justice through California’s Code of Civil Procedure 377.60. A car accident attorney can work on your behalf to investigate your claim and hold the negligent driver accountable for their actions. There are statute of limitations associated with being able to file a claim, so it’s important to act quickly.
