Liability In Rear-End Collisions
Every driver should be maintaining a safe distance with the vehicle ahead of them. According to the California DMV Handbook, “Scanning your surroundings (keeping your eyes moving) includes keeping a safe distance around your vehicle. When another driver makes a mistake, you need time to react. Give yourself this reaction time by keeping enough space on all sides of your vehicle. This space will give you room to brake or maneuver if necessary.” In most circumstances, there is a presumption of negligence when one driver rear-ends another vehicle.
Rear-end collisions almost always occur when one driver is following a vehicle too closely, distracted or speeding. Even if the vehicle in front of you stops abruptly you should have sufficient space to brake or maneuver. Victim’s of rear-end collisions can suffer from a variety of injuries including spinal injuries and traumatic brain injuries. Those who are injured in car accidents are able to seek financial compensation through a bodily injury claim.
