Liability In Water Truck Accidents
Truck companies are often considered “common carriers” under the law. As such, truck companies are held to a very high standard in terms of safety. According to Squaw Valley Ski Corporation v. Superior Court, “The elevated standard of care for common carriers is “based on a recognition that the privilege of serving the public as a common carrier necessarily entails great responsibility, requiring common carriers to exercise a high duty of care towards their customers.” Here are just a few of the most common causes of truck accidents according to the FMCSA:
- “Non-Performance: The driver fell asleep, was disabled by a heart attack or seizure, or was physically impaired for another reason.
- Recognition: The driver was inattentive, was distracted by something inside or outside the vehicle, or failed to observe the situation adequately for some other reason.
- Decision: For example, the driver was driving too fast for conditions, misjudged the speed of other vehicles, or followed other vehicles too closely.
- Performance: For example, the driver panicked, overcompensated, or exercised poor directional control.”
There is simply no excuse for any truck driver to hit a pedestrian as they are making a delivery. Truck drivers must use their mirrors and get out of their vehicle if need be and see what around them. If a truck driver hits a pedestrian they may be held liable through a civil claim. The family of a any person that is killed in a truck accident may have legal recourse through California Code of Civil Procedure 377.60.
