Luis Figueroa Woodland: Luis Figueroa Killed In Woodland Car Accident On Interstate 5 By County Road 22 –> Support The Victim’s Family Through Go Fund Me

WOODLAND, CALIFORNIA (June 26, 2019) – A 5-year-old child from Woodland identified as Luis Figueroa has tragically died in a car accident with a drunk driver on Interstate 5.

California Highway Patrol are saying that the accident took place around 9:00 p.m. A BMW was traveling north at a high rate of speed  when it hit a Nissan carrying Luis Figueroa from behind.

The force of the impact sen the Nissan pickup down a large embankment before it eventually overturned in a field. Three girls ages 10 and under were injured and are still recovering in the pediatric intensive care unit.

Despite life-saving efforts Luis Figueroa died due to his injuries. The driver of the BMW that hit them has been charged with vehicular manslaughter and felony DUI.

Liability In Car Accidents

Every driver has a legal responsibility to operate their vehicle according to the prevailing conditions of the road. Drivers that speed or operate their vehicles under the influence may face civil as well as criminal liability for an accident. According to California Vehicle Code 23152, “(a) It is unlawful for a person who is under the influence of any alcoholic beverage to drive a vehicle. (b) It is unlawful for a person who has 0.08 percent or more, by weight, of alcohol in his or her blood to drive a vehicle.”

According to the Center’s For Disease Control, “”Every day, 29 people in the United States die in motor vehicle crashes that involve an alcohol-impaired driver. This is one death every 50 minutes.1 The annual cost of alcohol-related crashes totals more than $44 billion.” There is simply no excuse to drink and drive. The problem is that so many people do it so often that they begin to become confident in their ability. But the truth is that even a moderate amount of alcohol can seriously impair a person’s reaction time and information processing abilities.

The family of any person that died in an accident with an intoxicated driver may have legal recourse through a wrongful death claim. A wrongful death claim can help a victim’s family with funeral expenses, medical bills, emotional trauma and pain and suffering. A wrongful death attorney can examine all of the facts of your case and let you know what your options are. There are, however, statute of limitations associated with being able to pursue a claim.
