Liability In Garbage Truck Accidents

Garbage trucks can weigh anywhere from 15-32 tons, more than 7 times heavier than a passenger car. Accidents with these vehicles can leave victims with devastating injuries and often result in death. Aside from their weight one of the main dangers of garbage trucks are their large blind spots. The blind spots are big enough to make a car disappear and can easily obscure motorcyclists.

Another serious danger with garbage trucks are left turn collisions. Drivers are supposed to yield the right of way to vehicles before turning left, according to California Vehicle Code 21801. But garbage truck operators can become distracted or fatigued and fail to see oncoming motorcyclists. A disproportionate number of motorcyclists are killed every year because other drivers are not paying attention before turning.

The family of a motorcyclists that died in an accident is protected by a number of laws. According to California’s code of civil procedure 377.60, a victim’s next of kin is able to hold a negligent driver accountable through a wrongful death claim. A motorcycle accident attorney can evaluate the specific facts of your case and let you know what your rights are.
