Liability In Pedestrian Accidents

All drivers have a common law duty to operate their vehicles in a reasonably safe manner and take steps to prevent hitting pedestrians. Pedestrians have the right of way when they are lawfully in a crosswalk. Despite this, many drivers do not pay attention as they are making left turns. This is a huge problem that results in thousands of accidents, injuries and deaths every year. More often than not a driver will face liability if they hit a pedestrian or car while making a left turn.

According to California Vehicle Code 21801 Section (a), “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.”

Unless a driver was turning on a green arrow, a pedestrian will usually have the right of way in a left turn accident. In addition to negligence on the part of a driver, there may also be negligence on the part of a city for a left turn pedestrian accident. Cities like West Covina have a responsibility to design roads that are reasonably safe. If an intersection was in a dangerous condition and this was the proximate cause of a pedestrian accident a city could face civil liability. It’s always a good idea to have an experienced pedestrian accident attorney examine the facts of your case for potential municipal negligence. There are very strict statute of limitations associated with municipal negligence claims, so it’s important to act quickly.
