Liability In Truck Accidents
According to reports from the FMCSA, nearly 4,000 people are killed in truck accidents every year. Those that manage to survive are left with catastrophic injuries. Trucks tend to have very large blind spots that could even make an SUV disappear. A number of collisions occur when truck drivers back up into driveways or otherwise make dangerous left turns.
According to the California Vehicle Code 21801, “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.”
Assessing liability in a truck accident can be extremely difficult. A truck accident attorney can conduct a thorough examination of your case and let you know what your options are. The victim’s family may have legal recourse through California Code of Civil Procedure 377.60. Damages in a civil claim can help a family with funeral expenses, lost wages and emotional trauma. An attorney can make sure that key pieces of evidence are preserved and that your rights are being protected.
