According to the Fresno Bee, Wonderful Citrus was cited for two accidents in 2016. Wonderful Citrus Packing LLC also faces a civil lawsuit from a worker for alleged age discrimination and wrongful termination.
Visalia police officials and Cal/OSHA are conducting an investigation into the fatal workplace accident.
Liability In Workplace Accidents
Companies in California are expected to take safety precautions to prevent accidents and injuries. This is all the more important for agricultural companies. They account for a disproportionate number of workplace accidents and deaths. In order to protect worker’s, companies in California must purchase worker’s compensation insurance. The family members of a deceased worker will likely be able to claim benefits through the worker’s compensation system.
What many people do not realize is that the worker’s compensation system may not be the only source of recovery following an accident. The family of a deceased worker may be able to file a third-party liability claim if an entity separate from a worker’s employer contributed to an accident. For example, if a wind machine malfunctions and causes an accident the family of the victim have the ability to file a product liability claim. A wrongful death attorney can investigate a workplace accident and let you know if there is potential third party negligence.
