Liability In Hit And Run Accidents

Every driver has a legal responsibility to operate their vehicle  according to the prevailing conditions of the roadway. According to California Vehicle Code 22350, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.” In the event of an accident, a driver should pull over and exchange insurance information

According to the Centers For Disease Control, “Almost half (48%) of crashes that resulted in pedestrian deaths involved alcohol for the driver or the pedestrian. One in every three (33%) of fatal pedestrian crashes involved a pedestrian with a blood alcohol concentration (BAC) of at least 0.08 grams per deciliter (g/dL) and 13% involved a driver with a BAC of at least 0.08 g/dL.” Most accidents take place after 6:00 p.m. when visibility is lower.

The family of a victim that died in a pedestrian accident may have the ability to seek justice through California Civil Code 377.60. Damages in a wrongful death claim may include compensation for lost wages, medical bills and pain and suffering. A wrongful death attorney can examine all of the facts of your case and let you know what your options are. There are statute of limitations associated with being able to pursue a claim, so it’s important to act quickly.
