Yaneli Morales Livermore: Yaneli Morales Killed In Livermore Car Accident By East Avenue near Jensen Street

LIVERMORE, CALIFORNIA (August 6, 2019) –  A 26-year-old woman identified as Yaneli Morales has tragically died in a car accident by the intersection of East Avenue near Jensen Street.

Livermore police are saying that Yaneli Morales was attempting to cross the street around 8:43 p.m. One bystander arrived at the scene within a minute and said that the victim had major head trauma.

Paramedics rushed to the intersection in order to help Yaneli Morales. Despite lifesaving efforts she later died due to her injuries.

A number of Livermore residents have been calling the intersection dangerous and that more needs to be done in order to protect pedestrians.

Neighbors say that East Avenue is a racetrack and that the flashing crosswalk lights are too dull. An investigation into the pedestrian accident that killed Yaneli Morales remains ongoing at this time.

“With heavy hearts we ask that you please donate to the Morales family. Heartbroken with the loss of Yaneli Morales, a sister, daughter, and an amazing individual who was loved by many. She was a young beautiful women who unexpectedly passed.”

Designing Intersections To Be Safe

According to the Centers For Disease Control, “In 2016, 5,987 pedestrians were killed in traffic crashes in the United States. This averages to one crash-related pedestrian death every 1.5 hours.1 Additionally, almost 129,000 pedestrians were treated in emergency departments for non-fatal crash-related injuries in 2015. Pedestrians are 1.5 times more likely than passenger vehicle occupants to be killed in a car crash on each trip.” There are steps that cities can take to help reduce pedestrian deaths:

  • Adequate lighting: Accidents tend to happen when intersections are dimly lit.
  • Stop signs: Some intersection have no safety signs or street lights.
  • Enforcement: Accidents happen when drivers break safety rules. Police officers must enforce traffic rules, especially in areas where drivers act dangerously.

Pedestrians involved in accidents often sustain critical injuries and require extensive medical care. Far too many pedestrians end up dying due to their injuries. Depending on the facts of any case there may be numerous sources of liability for a pedestrian accident.

Liability For Pedestrian Accidents

All drivers have a legal responsibility to operate their vehicles in a reasonably safe manner in order to avoid hitting pedestrians. According to California Vehicle Code 21950, “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, except as otherwise provided in this chapter.” But drivers are not always solely to blame for an accident.

A number of collisions take place due to intersections that are in a dangerous condition. A city may be liable for an accident if was caused by a dangerous road. According to California Government Code 835,  “Except as provided by statute, a public entity is liable for injury caused by a dangerous condition of its property if the plaintiff establishes that the property was in a dangerous condition at the time of the injury, that the injury was proximately caused by the dangerous condition.” For example, an intersection could be dangerous due to a lack of safety features like stop signs.

The family of any victim that died in a car accident may be able to seek justice through California Code of Civil Procedure 377.60. Potential claimants in a civil matter may include the victim’s siblings, parents, children or spouse. Damages in a civil claim can cover funeral expenses, lost wages, medical bills and pain and suffering. Cities like Livermore will often fight hard to deny liability for an accident. A car accident attorney can investigate all of the facts of your case free of cost and let you know what your legal rights are.
