Woman Injured After Being Dragged By San Francisco Muni Train After Train Door Closed On Her Finger At Embarcadero station
SAN FRANCISCO, CALIFORNIA (April 21, 2019) – A woman was injured after being dragged by a San Francisco muni train at the Embarcadero station after the train door closed on her hand.
A surveillance video of the accident showed the woman trying to get on the train only to have it close on her hand. She can be seen talking to an employee at the train station before being dragged underneath the moving train.
The San Francisco Municipal Transportation Agency (SFMTA) recently purchased new Muni train cars, including the locomotive involved in the accident. The spokesperson for the SFMTA assured reporters that the trains and their doors are safe.
But new reports being released indicate that this may not be the case. Some of the train operators have flagged issues with the doors and they were concerned about accidents exactly like the one that injured the victim.
A full investigation into the San Francisco muni train accident at the Embarcadero station remains ongoing at this time.
Train Accident Statistics
There are around 6,000 deaths and 2,300 injuries every year in train accidents. This may include pedestrian collisions, collisions with cars and derailments. Most victims are walking along or near the train tracks at the time they get hit. There are a number of other reasons why a train accident may occur.
- Pedestrians can misjudge the speed of the train. Many people are killed or seriously injured when pedestrians fail to understand how fast a train is going. They may try to cross and fall on the tracks before being hit.
- A number of accidents take place when cars stall on train tracks. Drivers may fail to hear an oncoming train as they are preoccupied with getting their car off the tracks.
- Never try to beat the crossing arms. It’s never a good idea to try to beat a speeding train. Be patient and wait for it to pass.
- Keep an eye out for a second train. Many people are hit and killed every year when they wait for one train before crossing a set of tracks only to be hit by a second train. This is particularly dangerous in areas where a second train may be hidden by trees or a blind corner.
No matter how safe a pedestrian or driver is accidents still happen. There are a number of situations where a transit authority may face liability for a train crash.
Liability In Train Accidents
A transit authority could face civil liability for a train accident. For example, a train station may be dangerous due to defects on the property. According to the California Civil Code § 1714 subsection (a), “Everyone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person, except so far as the latter has, willfully or by want of ordinary care, brought the injury upon himself or herself.” Pedestrians may trip and fall onto train tracks due to uneven paving.
Trains are machines like cars and other heavy equipment. They are not always designed to account for the various ways that people use them. A train manufacturer may face civil liability if a train door closes on someone and drags them. This type of accident is far more common than many people may realize. There are a number of safety features that can be added to trains and other vehicles to prevent these accidents, but they are not always implemented due to cost savings.
Even if a person is trespassing on a set of train tracks this does not give the conductor a license to run them over. Train engineers are train to spot pedestrians and other hazards on the tracks. They must give a warning sound with their horn and apply their brakes in order to try to avoid an accident. Failure to try to avoid pedestrians may result in civil liability for a transit authority. Any person that is injured in a train accident may be able to recover damages for lost wages, medical bills and pain and suffering.
