Liability In Santa Ana Bicycle Accidents

According to the Centers For Disease Control and Prevention, “Bicycle trips account for only 1% of all trips in the United States. However, bicyclists face a higher risk of crash related injury and deaths than occupants in motor vehicles. In 2015 in the United States, over 1,000 bicyclists died and there were almost 467,000 bicycle-related injuries.” There are a number of factors related to bicycle accidents including:

  • Speeding
  • Driver intoxication
  • Driver fatigue
  • Driver distraction
  • Inclement weather
  • Poor road design

Bicyclists have all the rights of other vehicles and drivers must take measures to use caution around them. According to California Vehicle Code 21200, “A person riding a bicycle or operating a pedicab upon a highway has all the rights and is subject to all the provisions applicable to the driver of a vehicle by this division, including, but not limited to, provisions concerning driving under the influence of alcoholic beverages or drugs, and by Division 10.” Victims of bicycle accidents are protected by a number of laws.
