Liability In Hit-And-Run Accidents
According to the Centers For Disease Control, “almost 129,000 pedestrians were treated in emergency departments for non-fatal crash-related injuries in 2015. Pedestrians are 1.5 times more likely than passenger vehicle occupants to be killed in a car crash on each trip.” Most pedestrian accidents tend to happen when drivers are either speeding or distracted.
It is a felony to flee the scene of an accident that results in bodily injury. According to California Vehicle Code 20001, “The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident and shall fulfill the requirements of Sections 20003 and 20004.”
Any person that is injured in a pedestrian accident may be able to seek justice through a bodily injury claim. Damages can help cover many of the financial problems caused by serious accidents. A pedestrian accident attorney can examine all of the facts of your case and let you know what your legal options are. Under California law, you may be entitled to help even if the at fault driver does not have insurance.
