Skateboarder Injured In Santa Ana Uber Car Accident By West McFadden Avenue and South Broadway

SANTA ANA, CALIFORNIA (September 24, 2019) – A skateboarder was injured in a car accident after being hit by an Uber driver by the intersection of West McFadden Avenue and South Broadway.

Santa Ana police are saying that the car accident took place around 1:03 a.m. For reasons that remain under investigation the skateboarder was hit by the Uber and knocked to the ground.

Paramedics were called to the scene in order to help the victim. The male skateboarder was lying down in the roadway before he was taken to a hospital in order to receive treatment.

The Uber driver remained at the scene by West McFadden Avenue and cooperated with police.

Liability In Uber Accidents

The rise of ride-sharing services like Uber and Lyft has come with an increased number of serious injury and fatal car accidents. According to one new study from the University of Chicago and Rice University, “The rise of ride-sharing services has increased traffic deaths by 2% to 3% in the US since 2011, equivalent to as many as 1,100 mortalities a year.” There are a number of factors potentially behind this trend.

Uber drivers are allowed to work very long hours that may prove to be unsafe. Steve Gregg is an Uber driver in the Bay Area. “I drive until I’m exhausted every day,” said Gregg. A number of drivers may work as much as 16 or 18 hours per day. Drivers are human like everyone else and they can easily get fatigued to the point that they can no longer drive safely. In fact, driving while fatigued can be just as dangerous as drunk driving. Staying awake for 18 hours straight is like driving with a BAC of 0.05

Uber drivers are supposed to yield the right of way to pedestrians in lawfully marked crosswalks. According to California Vehicle Code 21950, “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, except as otherwise provided in this chapter.” Drivers that fail to yield the right of way to pedestrians are likely to be found at fault in the event of an accident.

If an Uber driver was transporting someone during the time of an accident Uber’s insurance would typically apply. Pedestrians are protected by Uber’s $1,000,000 insurance policy. Victims of Uber accidents will typically have recourse through a bodily injury claim. Damages can help cover lost wages, medical bills and pain and suffering. An Uber accident attorney can examine all of the facts of your case and let you know what your legal options are.
