Liability In Simi Valley Bus Accidents

Bus companies are considered “common carriers” under the law. They are therefore held to a very high standard in terms of safety. According to the Judicial Council of California Civil Jury Instructions, “Common carriers must carry passengers [or property] safely. Common carriers must use the highest care and the vigilance of a very cautious person. They must do all that human care, vigilance, and foresight reasonably can do under the circumstances to avoid harm to passengers[or property].” There are a number of factors commonly associated with bus accidents including:

    • Speeding
    • Intoxication
    • Driver distraction
    • Alcohol use
    • Drug Use
    • Fatigue

Fatigue, in particular, is the most common factor associated with bus accidents. Bus drivers are often forced to work long hours and may not get the rest they need to be safe. In fact, it has been estimated that drowsy driving can be just as dangerous as driving with a BAC of 0.05. AAA says that getting less than 5 hours of sleep increases the risk of a crash by a factor of 4. The NTSB has outlined a number of steps that bus drivers should take to keep fatigue under control:

  • Drivers should get plenty of sleep and take periodic breaks
  • Drivers should manage customers expectations about scheduling
  • Drivers should check their prescriptions to see if they cause drowsiness
  • Bus companies should installed collision avoidance systems to mitigate or prevent crashes

If a bus driver is negligent and causes an accident they company that they work for will typically be held at fault. Companies are responsible for the negligent conduct of their employees –  insofar as those employees are working within the course and scope of their job duties.  According to FMCSA guidelines, if a bus carries over 15 passengers it must have at least $5,000,000 worth of liability coverage.

Any person that is injured in a bus accident may have legal recourse through a bodily injury claim. Damages can help cover all of your medical bills, lost wages and pain and suffering. It’s important to seek treatment after an accident so that your injuries can be documented. Unfortunately, bus companies will often fight hard to deny liability or downplay the extent of your injuries following an accident. A bus accident attorney can examine all of the facts of your case free of cost and let you know what your legal options are.
