RAINBOW, CALIFORNIA (July 27, 2019) – A 13-year-old boy identified as Jorge Vasquez was tragically killed in a car accident that injured his sister Silvana and his mother Silvia Campos.
California Highway Patrol are saying that the accident took place around 8:30 a.m. on Sunday by the intersection of Old Highway 395 and Rainbow Valley Boulevard.
Silvia Campos was driving a Honda Pilot carrying Silvana and Jorge Vasquez. A semi-truck carrying two rock-hauler trailers collided with the Honda Pilot.
The force of the impact caused the semi-truck to burst into flames. Despite life-saving efforts Jorge Vasquez died due to his injuries.
Both Silvia Campos and Silvana had to be transported to the hospital with serious injuries. Silvana has been able to return home, but Silvia Campos remains at the Palomar medical center.
A Go Fund Me page has been set up to help the family of Jorge Vasquez, Silvia Campos and Silvana. An investigation into the cause of the semi-truck accident remains ongoing at this time.
A number of Rainbow residents have come forward and called the intersection of Old Highway 395 and Rainbow Valley Boulevard dangerous. There is only a two way stop sign at the intersection.
Preventing Truck Accidents
According to the FMCSA, “In 2017, 4,889 large trucks and buses were involved in fatal crashes, a 9-percent increase from 2016. Although the number of large trucks and buses in fatal crashes has increased by 42 percent from its low of 3,432 in 2009, the 2017 number is still 7 percent lower than the 21st-century peak of 5,231 in 2005.” There are a number of measures that can be taken to help prevent fatal truck accidents:
- Avoiding blind spots
- Use caution when passing trucks
- Use clear signals
- Merge lanes carefully
- Avoid distractions
Even if a truck driver is perfectly safe a number of accidents happen at intersections that are in a dangerous condition. For example, a road could lack safety signs or a clear line of sight. Depending on the facts of any case there could be multiple sources of liability for a truck accident.
Liability In Truck Accidents
Truck drivers are held to a very high standard in terms of safety. They must operate their vehicle safely in accordance with the prevailing conditions of the road. According to California Vehicle Code 22350, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.”
Truck drivers are often forced to work long hours and this can impact their ability to drive safely. But drivers are not always to blame for an accident. Cities have a responsibility to design, construct and maintain roads that are reasonably safe. When a city is given constructive notice of a dangerous condition with a roadway they must take steps to fix the problem. When a city fails to correct dangerous roadways they may face civil liability in the event of an accident. Damages in a civil claim can help cover medical bills, lost wages and pain and suffering. A truck accident attorney can examine all of the facts of your case and let you know what your options are.
