MORRO BAY, CALIFORNIA (October 26, 2019) – A 55-year-old cook at Bayside Care Center identified as Shawn Cyphers was seriously injured in a hit-and-run car accident near the intersection of Quintana Road and Morro Bay Boulevard.

Morro Bay police are saying that the accident took place on October 16th. Shawn Cyphers was riding his bicycle home after work when he was hit by a pickup truck.

The driver of the pickup truck fled the scene and is currently being sought by police. Paramedics rushed to the scene in order to help Shawn Cyphers.

He was taken to the hospital in critical condition. Coworkers of the victim have set up a Go Fund Me page to help with his medical bills and to get him a new bicycle.

According to the Go Fund Me organizer, “Shawn was rushed to the hospital and brought to the ICU. He is currently still in the hospital and is stable, but the accident has left him with multiple broken ribs, both of his ankles broken, and in need of surgery.  Shawn is an incredibly kind and hardworking person. “

Liability In Morro Bay Bicycle Accidents

All drivers have a legal responsibility to keep an eye out for bicyclists and other pedestrians. According to California Vehicle Code 21200, “A person riding a bicycle or operating a pedicab upon a highway has all the rights and is subject to all the provisions applicable to the driver of a vehicle by this division, including, but not limited to, provisions concerning driving under the influence of alcoholic beverages or drugs, and by Division 10.” There are a number of reasons why bicycle accidents take place.

    • Driver intoxication
    • Driver distraction
    • Speeding
    • Driver fatigue

No matter what causes an accident drivers are supposed to remain at the scene and call for help. According to California Vehicle Code 20001, “The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident and shall fulfill the requirements of Sections 20003 and 20004.” Drivers that flee the scene of an accident may face civil as well as criminal liability.

Victims of bicycle accidents are protected by a number of laws. For example, a victim can recover damages for medical bills, lost wages and pain and suffering. A car accident attorney can examine all of the facts of your case free of cost and let you know what your legal options are. There are, however, statute of limitations associated with filing a civil claim. It is therefore important to act quickly.
