Liability In Lyft Accidents
All drivers have a responsibility to operate their vehicle in a reasonably safe manner and drive according to the prevailing conditions of the road. Drivers that are involved in collisions must stop and remain at the scene. According to California Vehicle Code 20001, “The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident and shall fulfill the requirements of Sections 20003 and 20004.”
It is a felony to flee the scene of an accident that causes bodily injury or death. Drivers that flee will likely face civil as well as criminal liability. Unfortunately, the hours between midnight and 2:00 a.m. contain a disproportionate number of drunk drivers. According to Mothers Against Drunk Driving (MADD), “In 2017, 15 percent of all drivers involved in fatal crashes during the week were drunk, compared to 28 percent on weekends.” Any person that died in an accident while inside a Lyft is protected by a number of laws.
Like it’s competitor Uber, Lyft has fairly extensive liability coverage in the event that a driver or any passenger are injured. According to Lyft’s website all of their drivers have: UM/UIM coverage – UM/UIM stands for “uninsured/underinsured motorist.” This policy provides up to $1 million per accident in the event of an accident with a driver who is “uninsured or underinsured and is ultimately at fault for bodily injury caused to you and/or your passengers.” There is no deductible for this policy.
The family of any person that died in a Lyft accident may be able to seek justice through California Code of Civil Procedure 377.60. Potential claimants in a civil claim may include a victim’s children, mother, father, brothers, sisters and spouse. Damages can help cover emotional trauma, funeral expenses and lost wages. There are, however, very strict statute of limitations associated with pursuing a claim, so it’s important to act quickly. A Lyft accident attorney can examine all of the facts of your case and let you know what your options are.
