Liability In Bicycle Accidents

According to the People Powered Movement, “Statistics show that while the overall number of bicycle accidents in the country is declining, the number of fatal bike accidents is on the rise. In 2015, there were 45,000 reported bicycle accidents in the United States, down from 50,000 reported accidents in the prior year. However, the number of fatal accidents increased by more than 12 percent during this same time.” There are a number of factors that contribute to bicycle accidents including:

  • Speeding
  • Drunk driving
  • Fatigued driving
  • Distracted driving

All drivers have a legal obligation to keep an eye out for pedestrians and do their best to avoid hitting them. This is true even when pedestrians are outside of legally marked crosswalks. According to California Vehicle Code 21950, “The driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk shall exercise all due care and shall reduce the speed of the vehicle or take any other action relating to the operation of the vehicle as necessary to safeguard the safety of the pedestrian.”

Any person that is injured in a San Francisco bicycle accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help with lost wages, medical bills and pain and suffering. A bicycle accident attorney can examine all of the facts of your case and let you know what your legal options are. It doesn’t cost anything to hire an attorney and they only get paid if they are able to successfully resolve your case.
