Liability In Truck Accidents

Nearly 5,000 people are killed every year in accidents involving commercial trucks. According to the FMCSA, there are hundreds of factors associated with truck accidents. What follows are the top 5:

  • Roadway problems
  • Required to stop before crash
  • Over-the-counter drug use
  • Inadequate surveillance
  • Fatigue

The major problem is truck driver fatigue. Truck drivers can work up to 14 hours in a day and they naturally get tired like everyone else. As fatigue sets in they are more likely to violate safety procedures. Truck drivers are supposed to yield the right of way to pedestrians that are in lawfully marked crosswalks.

According to California Vehicle Code 21950, “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, except as otherwise provided in this chapter.” If a truck driver is negligent and hits a pedestrian they may face civil liability for the accident.

The family of any victim that is injured in an accident due to the negligence of a truck driver may have legal recourse through California Code of Civil Procedure 377.60. Damages in a civil claim can help cover lost wages, medical bills, funeral expenses and pain and suffering. A truck accident attorney can investigate your claim free of cost and let you know what your legal options are.
