CARLIN, NEVADA (August 25, 2019) – Twelve people were injured and a Nevada Gold Mines worker identified as Rocky Witt from Spring Creek has tragically died in a bus accident on Nevada 766 Freeway.

Elko County police are saying that a tractor-trailer truck carrying ore crossed over the center line and hit a bus caring members of the Nevada Gold Mines head-on. Authorities believe that the  Pilot Thomas truck may have been going south on the Nevada 766 freeway when the bus accident took place.

Twelve people in total were injured. At least five people on the Coach USA mine bus were critically injured. One of the bus passengers has been identified as Rocky Witt.

Despite life-saving measures Rocky Witt later died due to his injuries. An investigation into the fatal head-on Carlin bus accident that killed Rocky Witt remains ongoing at this time.

Causes of Nevada Truck Accidents

According to one estimate by the NHTSA, “there were approximately 120,000 fatal and injury crashes nationwide during the 33-month study period that involved at least one large truck; 141,000 large trucks were involved in those crashes.” A fully loaded semi-truck can weigh 80,000 lbs and they are naturally top heavy. Many truck accidents occur when truck drivers take curves in the road too sharply or too fast.

Safely navigating a truck around a curve requires the truck driver to slow down appropriately.  This is why it’s so important for semi-truck drivers to get the training that they legally need. But many accidents are also caused by defects in the road. As seen in the diagram above, a safely constructed road curve should not have an angle in excess of 150 degrees. Depending on the facts of any case there may be numerous sources of liability for an accident involving a commercial truck.

Liability In Semi-Truck and Bus Accidents

According to the Nevada Association of Employers, “Nevada requires all private employers with one or more employees to get and maintain  workers’ compensation insurance. Workers’ compensation insurance provides benefits to employees who are injured on the job and protection to employers who have provided coverage at the time of injury. These benefits and protections are provided regardless of fault; making workers’ compensation no-fault insurance.” Damages from worker’s compensation can cover:

  • Temporary Total Disability
  • Temporary Partial Disability
  • Permanent Partial Disability
  • Vocational Rehabilitation Maintenance
  • Vocational Rehabilitation Training
  • Permanent Total Disability
  • Lifetime Re-Opening

What many workers don’t realize is that the worker’s compensation system may not be their only recourse after an accident. Victims may also be entitled to seek justice through a third party liability claim. A third party liability claim may be possible when an entity separate from a worker’s employer is responsible for an accident. For example, if a truck driver was negligent and caused an accident the company the they work for could be held responsible. There are a number of factors causally linked to truck accidents including:

  • Brake problems
  • Traffic flow interruption
  • Prescription drug use
  • Traveling too fast for conditions
  • Unfamiliarity with roadway
  • Roadway problems
  • Failure to stop before crash
  • Over-the-counter drug use
  • Inadequate surveillance
  • Fatigue

The family of any person that died in a bus accident in Nevada may be able to seek justice through a wrongful death claim. Damages in a wrongful death claim can help with funeral expenses, medical bills and lost wages. Unfortunately, truck companies will often fight hard to deny liability after an accident or downplay the extent of a person’s injuries. A truck accident attorney can examine all of the facts of your case free of cost and let you know what your legal rights are.
