Liability In Car Accidents

According to the Centers For Disease Control, “Every day, 29 people in the United States die in motor vehicle crashes that involve an alcohol-impaired driver.1 This is one death every 50 minutes. The annual cost of alcohol-related crashes totals more than $44 billion.” Driver’s that cause accidents while drunk will typically face criminal as well as civil liability.

It is a felony to operate a car while under the influence of alcohol and cause an accident resulting in bodily injury. According to California Vehicle Code 23152, “(a) It is unlawful for a person who is under the influence of any alcoholic beverage to drive a vehicle. (b) It is unlawful for a person who has 0.08 percent or more, by weight, of alcohol in his or her blood to drive a vehicle.”

If a person was injured in a car accident while they were working they may be entitled to worker’s compensation. According to the California Department of Industrial Relations Workers Compensation Guidebook, “If you get hurt on the job, your employer is required by law to pay for workers’ compensation benefits.” What many employees don’t realize is that they may also be entitled to additional benefits through a third party liability claim.

A third party liability claim may be possible if an entity separate from an employer caused an accident. Damages in a third party liability claim may include money for lost wages, medical bills and pain and suffering. A car accident attorney can examine all of the facts of your case and let you know what your legal options are. It doesn’t cost anything to hire an attorney and they only get paid if they are able to successfully resolve your case.
