Omar Ortiz Palmdale Trash Truck Accident: 40-Year-Old Omar Dominguez Ortiz Killed In Palmdale Garbage Truck Accident By Avenue M and 20th Street East

PALMDALE, CALIFORNIA (September 23, 2019) – A 40-year-old man identified as Omar Dominguez Ortiz has tragically died in a garbage truck accident by the intersection of Avenue M and 20th Street East.

Palmdale police are saying that the accident took place around 11:50 a.m. and involved a Waste Management garbage truck and a Honda fit.

For reasons that remain under investigation, the Honda Fit driven by Omar Dominguez Ortiz struck the side of the garbage truck as the garbage truck driver was making a left turn from 20th Street East onto Avenue M.

The driver of the Honda Fit sustained critical injuries and had to be treated by paramedics. Despite life-saving measures, Omar Dominguez Ortiz later died at the Antelope Valley Hospital. Police are asking anyone that may have seen the accident to reach out to them.

Some residents of Palmdale are concerned that the intersection may be dangerous and contributing to accidents. “The intersection has basic signals with no left turn arrows. M is 2 lanes each direction with a E/B to N/B left turn lane. S/B 20th E is single lane 2-way traffic with no separate left turn lane. SB 20th E ends for S/B traffic requiring a turn. Visibility for S/B 20th E to the West is somewhat obscured by power poles, full size tumble weeds and a fenced in power switching station. Another signal 325 feet East of first signal to control traffic from M to S/B 2oth E, could be a significant confusion factor,” said one user on the Antellope Valley Times’ site.

Liability In Garbage Truck Accidents

Garbage truck drivers have a legal obligation to operate their vehicles in a reasonably safe manner and to follow the speed limits. According to California Vehicle Code 22350, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.” Garbage trucks can be particularly dangerous because they have exceptionally large blind spots:

If a truck driver is not paying attention they can easily turn into the path of an oncoming vehicle and cause a serious accident. If a garbage truck driver makes a left turn in front of a vehicle they will typically be held at fault in the vent of an accident. According to California Vehicle Code 21801, “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement.”

It’s important that evidence is preserved after an accident. Most intersections will have traffic cameras. Even if an intersection does not have a traffic camera local businesses will often have footage of the accident. Unfortunately, garbage truck companies will often fight hard to deny liability for an accident. A truck accident attorney can examine all of the facts of your case free of cost and make sure that key pieces of evidence are being preserved.

The family of a victim that died in a garbage truck accident are protected by a number of laws. For example, the family of a victim may have legal recourse through a wrongful death claim. Damages can help cover the cost for funeral expenses, medical bills lost wages and pain and suffering. Parents, children, spouses and siblings are all potential beneficiaries. There are, however, very strict statute of limitations associated with filing a claim. It is therefore important to act quickly.
