Liability In DUI Car Accidents

When a worker is injured in California they will typically be entitled to a number of benefits. According to the California Department of Industrial Relations Workers Compensation Guidebook, “If you get hurt on the job, your employer is required by law to pay for workers’ compensation benefits.”  Benefits can help cover:

  • Medical care
  • Temporary Disability
  • Permanent Disability

In addition to worker’s compensation an injured worker can recover additional damages through a third party liability claim. A third party liability claim may be possible if an entity separate from a worker’s employer was responsible for an accident. A third party could be a negligent driver that caused an accident.

Drivers that drink and drive will tend to face criminal as well as civil liability. According to California Vehicle Code 23152, “(a) It is unlawful for a person who is under the influence of any alcoholic beverage to drive a vehicle. (b) It is unlawful for a person who has 0.08 percent or more, by weight, of alcohol in his or her blood to drive a vehicle.”

Any person that is injured in a car accident due to the negligence of a drunk driver can hold them accountable through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A car accident attorney can examine all of the facts of your case and let you know what your legal options are.
