Growing Trend Of Hit-And-Run Accidents
According to one study, hit-and-run accidents are at an all time high. There has been a 60% spike between 2009 – 2016. New Hampshire has the lowest number of hit-and-runs per capita while New Mexico had the highest. Researchers have proposed a number of theories to help explain this trend. In general, people are simply more distracted than they have been in the past. Smartphones and GPS use remain high and are a leading contributor to hit-and-run accidents. Alcohol use has also played a significant role. Victims of hit-and-run accidents often have traumatic injuries and may need to take time off work. A pedestrian accident attorney can take steps to help get victims or their family compensation after an accident for lost wages medical bills and pain and suffering.
Liability In Pedestrian Accidents
Drivers have a common law responsibility to operate their vehicles in a reasonably safe manner and to take steps to avoid accidents. Most pedestrian accidents happen between 6:00 p.m. and 9:00 p.m. It is especially important to be vigilant. Pedestrians are relatively small and may wear dark clothing. If a driver is distracted and hits another pedestrian they may face civil liability for what happened. If a person takes off after an accident they may also face criminal penalties. It is a felony to leave the scene of an accident in California that causes bodily injury. Even if a negligent driver does not have car insurance, a victim or their family may have the ability to recover damages under Proposition 213.
