Deaths In Police Custody
The Bureau of Justice has reported that 4,813 people have died during or shortly after being restrained by police officers. There are a number of contributing factors to this trend. For example, a number of police officers simply don’t have the experience to deal with suspects that are under the influence of drugs or experiencing a mental health crisis. Police have often used excessive force to restrain suspects or even beat them once they’ve been restrained. Tasers, in particular, can be very dangerous if they are used on a person who is under the influence. Depending on the facts of any case, a victim’s family may have the ability to file a wrongful death claim for damages.
Liability For Deaths In Police Custody
Police officers are required to use reasonable force in order to get suspects to comply with their demands. Great care must be put into making sure that suspects are safe before and after they are arrested. Once a police officer assumes control of a person by placing them in handcuffs and putting them under arrest the police department is responsible for the well being of that suspect. A number of people every year die after they go into a medical emergency and aren’t given treatment fast enough. Victims of the family may be able to recover damages for lost wages, medical bills and pain and suffering by hiring a wrongful death attorney.
