Brookview Apartments Balcony Collapse: Mountain View Balcony Collapse Accident At Brookview Apartments On East Middlefield Road Injured Four People

MOUNTAIN VIEW, CALIFORNIA (September 13, 2019) – At least four people were injured in a balcony collapse accident at the Brookview Apartments located on East Middlefield Road.

Mountain View police are saying that the Brookview Apartments balcony collapse took place around 9:08 p.m. Four people were on the balcony when it collapsed.

One of the victims sustained a pelvic fracture and required surgery. Linyang Mu lives on the first floor and told reporters the balcony collapsed onto her patio.

A number of balconies in the Brookview Apartments were scheduled to be replaced due to dry rot in 2016. The particular balcony that collapsed does not appear to have been listed for replacement.

An investigation into the cause of the Mountain View balcony collapse remains ongoing at this time. This accident comes just four years after six people were killed in a balcony collapse in Berkeley.

Causes of Balcony Collapses

According to one report from the Chicago Tribune, “An estimated 6,500 people have been rushed to emergency rooms with injuries from collapsing balconies and porches, while 29 — including six college students in Berkeley this week — have been killed since 2003.” Here are just a few of the reasons that balconies collapse:

  • Structures that aren’t up to code
  • Balconies that are exposed to weather
  • Poor engineering
  • Dry rot

Victims of balcony collapses are often left with a number of very serious and costly injuries including broken bones, pelvic fractures, head injuries and spinal cord trauma. Depending on the particular facts of any case there may be numerous sources of liability for a balcony collapse.

Liability In Mountain View Balcony Collapses

Apartment complexes like the Brookview Apartments have a legal responsibility to maintain the premises in a reasonably safe manner. According to California Civil Code 1714, “Everyone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person, except so far as the latter has, willfully or by want of ordinary care, brought the injury upon himself or herself.”

In many situations, apartments outsource maintenance work to third party companies. Those companies must do their due diligence and periodically inspect balconies for damage or dry rot. Dry rot weakens the structurally integrity of balconies over times and should be replaced promptly. If those companies fail to work on faulty balconies or even inspect them in the first place they could be liable in the event of an accident.

Any person that is injured in a balcony collapse may have legal recourse through a premises liability claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Unfortunately, apartment complexes will often fight hard to deny liability for an accident. A premises liability attorney can examine all of the facts of your case free of cost and let you know what your legal options are. An attorney can investigate and get to the bottom of what went wrong.
