Liability For Ramona Tow Truck Accidents
All tow truck drivers have a legal responsibility to operate their vehicles in a reasonably safe manner and take steps to avoid causing accidents. According to the FMCSA, “Fatigue, drinking alcohol, and speeding are major factors in motor vehicle crashes overall. Although their presence does not always result in a crash, these three factors, as well as other driver, vehicle, and environmental factors, can increase the risk that a crash will occur.” Here are just a few of the other factors that may contribute to truck accidents:
- Felt under work pressure from carrier
- Over-the-counter drug use
- Unfamiliar with roadway
- External distraction
- Tire problems
Motorcyclists are small by their very nature and are therefore more likely to be overlooked by other drivers. A number of very serious accidents occur when drivers make dangerous left turns. According to California Vehicle Code 21801, “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement.”
If a tow truck driver is negligent and causes an accident the company that they work for may also face civil liability. Generally speaking, companies are responsible for the negligent conduct of their employees. Any person that is injured in a tow truck accident may have legal recourse through a bodily injury claim. Damages in a bodily injury claim can help cover lost wages, medical bills and pain and suffering. A motorcycle accident attorney can examine all of the facts of your case and let you know what your legal options are.
