Liability In Truck Accidents
When a worker is injured in California there are a number of laws designed to protect their rights. According to the California Department of Industrial Relations Workers Compensation Guidebook, “If you get hurt on the job, your employer is required by law to pay for workers’ compensation benefits.” Victims will typically qualify for lost wages, medical care and disability benefits.
What many workers don’t realize is that the worker’s compensation system may not be their only recourse after an accident. Workers are barred by statute from bringing civil claims against their employer – with limited exceptions. But if an entity separate from a worker’s employer caused an accident they may be liable. A third party could potentially be another driver on the road that was negligent.
Drivers that fail to yield the right of way at stop signs will typically be held at fault. According to California Vehicle Code 22450, “The driver of any vehicle approaching a stop sign at the entrance to, or within, an intersection shall stop at a limit line, if marked, otherwise before entering the crosswalk on the near side of the intersection.” Victims of care accidents are protected by a number of laws.
Any person that is injured in a car accident may have legal recourse through a bodily injury claim. Damages can help cover lost wages, medical bills and pain and suffering. Victims often times may not even realize the full extent of their injuries until several weeks or months later. The smart thing to do after an accident is to seek medical treatment and then contact a car accident attorney. An attorney can make sure that your rights are being protected and that you get the support you deserve.
