Liability In Tractor Accidents

There could be many sources of potential negligence in a farm accident involving a tractor. Despite what many people may think agriculture is actually one of the most dangerous industries in the world. Within agriculture, tractor accidents are actually fairly common. Here are just a few of the most common types of tractor accidents

  • Rollover Accidents: Rollover accidents kill an estimated 60 people every year.
  • Collisions With Cars: Around 50 people are killed in tractor accidents with other vehicles. Tractors lack many of the safety features common in cars like air bags.
  • Entanglement: Around 10 people are killed every year after becoming entangled in some part of the tractor – such as the gears, chains, pulleys and belts.
  • Falling Or Tipping: Tractors are top heavy by nature and thus much more susceptible to tipping over than cars.

There are safety features on tractors that are designed to mitigate some of these risks. For example, tractors are supposed to have roll-bars in order to prevent workers from being crushed if a tractor does rollover. If a tractor malfunctioned or was otherwise defective the manufacturer of the tractor could be held responsible through a product liability claim.

The family of any worker that died in a tractor accident may have legal recourse through a wrongful death claim. Damages can help cover funeral expenses, lost wages, medical bills and pain and suffering. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
