Liability In Semi-Truck Accidents
Semi-truck drivers have a legal responsibility to operate their vehicles in a reasonably safe manner and take steps to avoid hitting pedestrians. It is a felony to flee the scene of an accident that causes bodily injury or death. According to California Vehicle Code 20001, “The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident and shall fulfill the requirements of Sections 20003 and 20004.” The FMCSA cites a number of factors commonly associated with truck accidents:
- Inadequate surveillance
- Over-the-counter drug use
- Felt under work pressure from carrier
There is a notable increase in the number of car accidents that happen at night. Despite the fact that there is statistically 60% less traffic at night 40% of all fatal car accidents occur at night. Fatigue is one of the major factors behind a number of truck accidents. Truck drivers work long hours and can easily become tired at night. Drivers are supposed to get enough sleep but this does not always happen. Part of the problem is that truck drivers are more likely to develop sleep disorders. A recent survey of truck drivers found that 85% of them tested positive for some sleeping condition.
There is simply no reason that a truck driver should ever hit a pedestrian by the side of the road. Good drivers are supposed to keep an eye out for pedestrians even when they are outside of lawfully marked crosswalks. According to California Vehicle Code 21950, “The driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk shall exercise all due care and shall reduce the speed of the vehicle or take any other action relating to the operation of the vehicle as necessary to safeguard the safety of the pedestrian.”
Many truck drivers work as independent contractors, but a number are also employed. If a truck driver is negligent and they cause an accident they company that they work for may face liability as well. Under the legal doctrine of respondeat superior employers are generally liable for the negligent conduct of their employees – insofar as those employees are working within the course and scope of their job duties. Victims of truck accidents often suffer from a wide variety of injuries including:
- Broken bones
- Head injuries
- Internal trauma
- Organ damage
The family of any victim that died in a semi-truck accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills, funeral expenses, loss of love and pain and suffering. Potential claimants in a civil matter may include a victims spouse, children, parents or siblings. Unfortunately, truck companies will often try to deny liability after an accident. A truck accident attorney can investigate all of the facts of your case free of cost and help ensure that your rights are being protected.
