CERRITOS, CALIFORNIA (October 4, 2019) – A 34-year-old man identified as Miguel Gutierrez Fabian has tragically died in a hit-and-run truck accident on the 91 freeway not far from Bloomfield Avenue. 

California Highway Patrol are saying that the accident took place around 12:10 a.m. Miguel Gutierrez Fabian was assisting his 16-year-old nephew who had run out of gas by the side of the freeway. 

For reasons that remain under investigation Miguel Gutierrez Fabian was hit by a white work truck that had rails on the side. The driver of the work truck continue down the road without stopping. 

California Highway Patrol are hoping that a large piece of debris that came off the truck will help them locate the driver. Investigators have already been able to determine that it was a 1992 to 1997 two-axle, International 4700 cab/chassis commercial truck.

Paramedics were called to the scene in order to help Miguel Gutierrez Fabian. Despite life-saving efforts the victim died due to his injuries. 

Miguel Gutierrez Fabian leaves behind a wife of three years. The couple knew each-other since high school.

Liability In Semi-Truck Accidents

Semi-truck drivers have a legal responsibility to operate their vehicles in a reasonably safe manner and take steps to avoid hitting pedestrians. Drivers are supposed to get enough sleep but this does not always happen. Part of the problem is that truck drivers are more likely to develop sleep disorders. A recent survey of truck drivers found that 85% of them tested positive for some sleeping condition. 

There is simply no reason that a truck driver should ever hit a pedestrian by the side of the road. Good drivers are supposed to keep an eye out for pedestrians even when they are outside of lawfully marked crosswalks. According to California Vehicle Code 21950, “The driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk shall exercise all due care and shall reduce the speed of the vehicle or take any other action relating to the operation of the vehicle as necessary to safeguard the safety of the pedestrian.”

Many truck drivers work as independent contractors, but a number are also employed.
