Michelle Gorman San Carlos: Single Mother Seriously Injured After Van Making Left Turn From Navajo Road To Boulder Lake Avenue Ran Into Her
SAN CARLOS, CALIFORNIA (January 11, 2019) – A woman from San Carlos identified as Michelle Gorman was seriously injured after she was hit by a van while she was in the middle of a crosswalk by Navajo Road and Boulder Lake Avenue.
The driver of the van was turning left at the time that he hit the victim. Good Samaritans sprang into action and began providing assistance to Michelle Gorman. She was taken to the hospital in serious condition.
According to Michelle Gorman’s Go Fund Me Page, “The force of the hit fractured my back in 6 places. I had to have a portion of my intestines removed due to damage. My appendix was also removed. I lost over a pint of blood and suffered many cuts and bruises. I spent the next 5 days in the hospital.”
She faces extensive medical bills and has had to miss work due to her injuries. An investigation into the San Carlos car accident remains ongoing at this time.
Liability In Left Turn Accidents
Pedestrians in a marked crosswalk have the right of way. Drivers should yield if they are intending to make a left turn, according to California Vehicle Code 21801. Unfortunately, this doesn’t always happen. Drivers making left turns can become distracted as they try to focus on oncoming traffic. Pedestrian accidents can leave victims with lasting injuries and high medical bills. Depending on the facts of any case liability may extend beyond the driver of a vehicle.
Cities like San Carlos have a responsibility to design, construct and maintain roads that are reasonably safe. According to California government code 835, a city may be liable for an accident if the plaintiff establishes that it was in a dangerous condition and “created a reasonably foreseeable risk of the kind of injury which was incurred.” A car accident attorney can evaluate the specific facts of your case and let you know if you have a claim that can be pursued.
