In addition to negligence on the part of a driver, there may also be negligence on the part of a city if the accident was caused by a dangerous condition in the roadway.
According to the California Government Code 835, a public entity can be held liable for an accident which is proximately caused by a dangerous condition on public property even if the accident also involved the third party negligence of another driver.
