Whipple Road and Dyer Street

UNION CITY, CALIFORNIA (December 20, 2018) – A 37-year-old man identified as Mansoor Jan died in a truck accident while driving through the intersection of Whipple Road and Dyer Street  by Hayward.

Union City police rushed to the scene of the car accident that took place around 4:21 a.m. There is no word yet on how the collision took place.

Mansoor Jan, who is from Dublin, sustained traumatic injuries and had to be taken to the hospital. Tragically, doctors were not able to save the victim and he was pronounced dead at the hospital.

Police interviewed the truck driver who remained at the scene and cooperated. It is unknown at this time if charges will be filed.

Hayward police are asking anyone that may have seen the accident to come forward. Whipple Road and Dyer Street can be extremely busy and dark at night.

Union City authorities are scheduled to make a number of design changes to both roads in order to improve safety.

Liability In Car Accident With Commercial Trucks

There are a number of entities that could potentially face liability for the tragic accident that killed Mansoor Jan. If a truck driver is distracted and hits a vehicle they could face civil liability. The economic impact of a truck accident with injuries has been estimated to be $200,000 by the FMCSA. This is why most trucking companies carry insurance policies between $500,000 to $1,000,000.

If the driver of a truck was working at the time of the accident, the company that employed them could be held vicariously liable. Companies are generally held liable for the negligence of their employees when those employees are working within the course and scope of their employment. In addition to negligence on the part of a driver, there may also be negligence on the part of a city if the accident was caused by a dangerous condition in the roadway.

According to the California Government Code 835, a public entity can be held liable for an accident which is proximately caused by a dangerous condition on public property even if the accident also involved the third party negligence of another driver. An intersection might be in a dangerous condition if it lacks basic safety features like lights. If there is a history of accidents along a particular road that will put the city on notice that there are safety concerns that need to be addressed. It’s important to seek the legal guidance of an experienced truck accident attorney if you’ve been involved in an accident.
