Wildomar Truck Accident: Man Killed In Wildomar Semi-Truck Accident By Bundy Canyon Road and Christopher Lane

WILDOMAR, CALIFORNIA (October 12, 2019) – A pedestrian has tragically died in a semi-truck accident on Tuesday near the intersection of Bundy Canyon Road and Christopher Lane.

California Highway Patrol are saying that the accident took place around 6:00 a.m. The pedestrian was walking along the dirt shoulders when he was struck by the semi-truck.

Paramedics were called to the scene in order to help the victim. Despite life-saving efforts the pedestrian died due to his injuries.

Wildomar police closed both sides of Bundy Canyon Road for several hours as they continued their investigation.

Liability In Wildomar Semi-Truck Accidents

All truck drivers have a legal responsibility to operate their vehicles in a reasonably safe manner and take steps to avoid hitting pedestrians. According to California Vehicle Code 21950, “The driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk shall exercise all due care and shall reduce the speed of the vehicle or take any other action relating to the operation of the vehicle as necessary to safeguard the safety of the pedestrian.” There are a number of factors associated with semi-truck accidents including:

  • Fatigue
  • Intoxication
  • Distraction
  • Inclement weather
  • Mechanical problems

A disproportionate number of pedestrian accidents take place during the early morning hours when it is dark. According to one report from the NHTSA

  • The highest total percentage (26%) occurred from 6 to 8:59 p.m.,
    followed by 23% from 9 to 11:59 p.m.
  •  The lowest total percentage (5%) occurred from 9 to 11:59 a.m.,
    followed by 6% from 12 to 2:59 p.m.
  • The highest weekday percentage (25%) occurred from 6 to
    8:59 p.m., followed by 19% from 9 to 11:59 p.m.
  • The highest weekend percentage (28%) occurred from 6 to
    8:59 p.m. and 9 to 11:59 p.m., followed by 17 percent from 12
    to 2:59 a.m.

If a truck driver is negligent and hits a pedestrian the company that they work for may face civil liability. Generally speaking, companies are responsible for the negligent actions of their employees – insofar as those employees are working within the course and scope of their job duties. It’s important that evidence is preserved and that eye witness testimony is collected after an accident.

The family of any victim that died in a pedestrian accident may have legal recourse through California Civil Code 377.60. Damages in a civil claim can help cover funeral expenses, lost wages, medical bills and loss of love. According to the statute, potential claimants in a civil matter may include the victim’s spouse, children, siblings and parents. Unfortunately, truck companies will often try to deny liability for any accident they are involved in. A truck accident attorney can examine all of the facts of your case and make sure that your rights are being protected.
