Federal and State Bus Regulations
There are a number of rules and regulations that apply to bus companies, including both at the state and federal level. Federal regulations apply for commercial motor vehicles that transport passengers across state lines. Companies that engage in “for-hire” transportation services must adhere to the FMCSA’s commercial regulations. Vehicles with a seating capacity of 16 or higher are required to carry $5 million worth of insurance coverage. Here are just a few of the safety regulations that will apply to bus companies:
Bus drivers should have valid driver’s licenses and every bus transit system should have criteria for the qualification and selection of drivers. Drivers should also undergo periodic medical examinations in order to ensure that they are healthy enough to operate their bus.
Every bus driver should be provided with written operational and safety procedures before they are allowed onto the road unsupervised.
All buses over 22-feet in length must have a rear exit door brake that is automatically applied when the exit door is open.
Buses must pass a rigorous test for structural integrity. Bus companies must submit proof of structural integrity to the department of transportation.
All buses should be “regularly and systematically inspected, maintained, and lubricated by the owner or operator in accordance with the manufacturer’s recommendations, or more often if necessary to ensure the safe operating condition of the vehicle”
Buses can weigh an order of magnitude more than passenger vehicles. An impact at even a low speed can cause serious injuries or even death. A bus accident attorney can investigate the specific facts of your case and take steps to make sure that your rights are being preserved.
Liability In Accidents Involving Tour Buses
There are a number of entities that may bear liability for the tragic bus crash that killed Lumumba Richard and Renee Rodriguez. Bus drivers have a duty to operate their vehicles with the utmost care and caution. Even the slightest deviance from best practices can have lethal consequences. If a bus is involved in a rear end collision, there’s a presumption of negligence on the part of the bus driver. Rear end collisions are almost always indicative that a driver was either going too fast or maintaining an unsafe distance with the vehicle in front of it. When bus drivers are negligent during a transportation route, the company that they work for will typically bear vicarious liability.
In certain circumstances, other companies may also bear civil liability for a bus accident if it was caused by faulty brakes. A bus’ brakes are put under enormous strain over time. This is why it’s critical that regular maintenance is performed in order to make sure they are in working order. Moreover, there are signs of brake failure before a vehicles brakes actually give out. Even in the middle of a brake failure, there are steps that should be taken in order to reduce the impact of a crash. Bus drivers should mechanically pump the brakes and engage the emergency brakes. Any person that is injured in a bus accident due to the negligence of a bus driver or third party may have the ability to file a personal injury claim in order to recover damages.
