Los Banos High School Student Injured In Car Accident At HAWK Crosswalk In Front Of Mercey Springs Elementary School

LOS BANOS, CALIFORNIA (August 27, 2019) – A Los Banos High School student was injured in a car accident at a HAWK Mercy Spring Road crosswalk.

Los Banos police are saying that the accident took place around 7:35 p.m. in front of Mercey Springs Elementary School. The Young girl was on her way to Los Banos High School when she was hit by a car making a turn.

Paramedics were called to the scene and described the victim as alert and responsive. She was taken to the hospital in order to receive treatment.

Caltrans recently installed the HAWK crosswalk signal at the intersection. School officials say that it makes the crossing safer, but they would prefer a stop light.

An investigation into the car accident that injured the Los Banos High School student remains ongoing at this time.

Liability In Car Accidents

According to the Centers For Disease Control, “almost 129,000 pedestrians were treated in emergency departments for non-fatal crash-related injuries in 2015. Pedestrians are 1.5 times more likely than passenger vehicle occupants to be killed in a car crash on each trip.” Most pedestrian accidents occur when drivers are:

  • Speeding
  • Intoxicated
  • Distracted
  • Fatigued

Even if a pedestrian is outside of a legally marked crosswalk, drivers are supposed to use caution in order to avoid hitting them. According to California Vehicle Code 21950, “The driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk shall exercise all due care and shall reduce the speed of the vehicle or take any other action relating to the operation of the vehicle as necessary to safeguard the safety of the pedestrian.” Depending on the facts of any case a city could be liable for an accident.

Cities have a legal responsibility to design, construct and maintain roads that are in a reasonably safe condition.  According to California Government Code 835, a city could be held liable for an accident if it was caused by a dangerous condition on public property. An intersection could be in a dangerous condition if it lacks basic safety features to help keep pedestrians safe.

Any person that is injured in a pedestrian accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. It’s important that evidence is preserved after an accident and that victims get medical treatment. A car accident attorney can examine all of the facts of your case and let you know what your legal options are.
