Car Accidents Involving Medical Conditions
According to the Association for the Advancement of Automotive Medicine, “Driving is a cognitively complex task related to multiple functions, many of which can be diminished or altered by chronic medical conditions. Numerous studies have addressed the role of medical conditions in the causation of motor vehicle crashes. Conditions such as epilepsy and diabetes mellitus, which can cause loss of consciousness or loss of body control, have always been of special concern with regard to traffic safety.”
There are a number of medications as well that could affect or impair a person’s ability to drive safely. It’s important to consult your doctor and check to make sure that you are healthy enough to drive. Seniors in particular are much more likely to experience “pedal confusion.” This occurs when a driver mistakes the accelerator for the brakes. Depending on the facts of any case, there may be multiple forms of liability for any car accident.
Liability In Car Accidents
Drivers have a responsibility to operate their vehicles according to the prevailing conditions of the road. According to California Vehicle Code 22350, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.”
If a person drives too fast and causes an accident they may face civil liability. But driver negligence is not always the sole cause of an accident. A car company like Tesla could face liability if their vehicle malfunctions. The star of Disney’s live action Aladdin has filed a claim against the car manufacturer after he claims a defect forced his car to hit a tree.
Any person that is injured in a car accident may be able to file a claim for damages. This can include compensation for lost wages, medical bills and pain and suffering. The family of any victim that died in a car accident may be able to seek justice through California Code of Civil Procedure 377.60. A car accident attorney can investigate your case free of cost and let you know what your options are.
