Liability In Hit-And-Run Accidents

According to one report from CNBC, “An estimated 6,227 pedestrians were killed in 2018, an increase of 250 from 2017, the Governors Highway Safety Association said Thursday. The association based its estimate on data collected by state highway safety offices.” Pedestrian accidents tend to occur between the hours of 6:00 p.m. to 9:00 p.m.

All drivers must keep an eye out for pedestrians even when those pedestrians are outside of lawfully marked crosswalks. According to California Vehicle Code 21950, “The driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk shall exercise all due care and shall reduce the speed of the vehicle or take any other action relating to the operation of the vehicle as necessary to safeguard the safety of the pedestrian.”

The family of any victim that died in a pedestrian accident may have legal recourse through California Code of Civil Procedure 377.60. Damages in a civil claim can help cover funeral expenses, lost wages, medical bills, loss of love, loss of care and pain and suffering. A victim’s surviving spouse, children, parents and siblings all may be eligible for a civil claim. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
