Liability In Hit-And-Run Accidents
According to the NHTSA, “Most pedestrian deaths occur in urban environments (73%) rather than rural, at non-intersection locations (70%) rather than intersections or other configurations, and during the night (70%). One in 5 (19%) pedestrian fatalities were hit-and-run.” Pedestrians that survive hit and run collisions are often left with very serious injuries including:
- Broken bones
- Spinal cord injuries
- Wrist injuries
- Head injuries
- Post traumatic stress disorder
It is a felony to flee the scene of an accident that results in bodily injury. According to California Vehicle Code 20001, “The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident and shall fulfill the requirements of Sections 20003 and 20004.” Drivers that choose to flee the scene of an accident may face civil liability.
Victims of hit and run collisions may be able to recover damages through a civil claim. Damages can help cover lost wages, medical bills and pain and suffering. If the victim was working at the time of an accident they may also be entitled to worker’s compensation. It is important to seek medical treatment after an accident. Failing to seek medical treatment may jeopardize your ability to file a claim down the line.
