Liability In DUI Car Accidents
It is a felony to operate a motor vehicle under the influence of alcohol and cause an accident that results in bodily injury. According to California Vehicle Code 23152, “(a) It is unlawful for a person who is under the influence of any alcoholic beverage to drive a vehicle. (b) It is unlawful for a person who has 0.08 percent or more, by weight, of alcohol in his or her blood to drive a vehicle.” Victims of DUI accidents often suffer from a wide variety of very serious injuries including:
- Head injuries
- Back injuries
- Broken bones
- Organ damage
Drunk drivers, by contrast, are more likely to survive accidents or avoid serious injury than their victims. According to the study by the University of Illinois at Chicago (UIC), “an appreciable blood-alcohol level seem to increase a trauma victim’s chances of survival after being admitted to a hospital, but that the drunker a victim is, the more likely he or she is to survive.” Victims of DUI accidents can seek justice through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A car accident attorney can examine all of the facts of your case and let you know what your rights are.
