Joseph Converse Santa Rosa: Joseph Converse Died In Santa Rosa Bicycle Accident On Petaluma Hill Road

SANTA ROSA, CALIFORNIA (July 28, 2019) – A 39-year-old cyclist identified as Joseph Converse was tragically killed in a car accident after being hit by two cars on Petaluma Hill Road.

California Highway Patrol are saying that the accident took place around 12:15 a.m. Police are saying that Joseph Converse was hit by a woman driving a 2009 Ford Focus.

Joseph Converse was ejected from his bicycle and then run over by a 28-year-old woman driving a 2017 Subaru Legacy. Both drivers remained at the scene of the accident.

Firefighters and paramedics rushed to the scene to help the victim. Despite life-saving efforts he later died due to his injuries.

An investigation remains ongoing at this time.

Liability In Bicycle Accidents

All drivers have a legal responsibility to operate their vehicles in a reasonably safe manner and take steps to avoid hitting cyclists, even if they are not in a bicycle lane. According to California Vehicle Code 21950, “This section does not relieve a pedestrian from the duty of using due care for his or her safety. No pedestrian may suddenly leave a curb or other place of safety and walk or run into the path of a vehicle that is so close as to constitute an immediate hazard.” Accidents tend to occur when drivers are:

  • Distracted
  • Intoxicated
  • Speeding
  • Fatigued

But driver error may not be the only source of negligence for an accident. A city may be liable for a bicycle accident if it was caused by a dangerous condition on the road. For example, a road may have very narrow shoulders or lack adequate bicycle lanes. The family of any person that died in a bicycle accident may have legal recourse through California Code of Civil Procedure 377.60. Damages can help cover funeral expenses, medical bills, lost wages and pain and suffering.
