ZAMORA, CALIFORNIA (August 28, 2019) – Two people have tragically died and three people identified as Jose Favela, Yolanda Favela and Marisol Favela were injured in a semi-truck accident on County Road 95.

California Highway Patrol are saying that the accident took place around 12:17 a.m. A 28-year-old man driving a box truck parked his truck on the shoulder of the road.

As the driver of the box truck was pulling away from the shoulder of the freeway there was a collision with a 2006 Ford SUV. There were 5 people in the Ford SUV including Jose Favela, Yolanda Favela and Marisol Favela.

Both the box truck and the SUV became engulfed in flames as a result of the crash. Two people were tragically pronounced dead due to their injuries.

Paramedics rushed to the scene and took Jose Favela, Yolanda Favela and Marisol Favela to the hospital with major injuries. The victims are believed to have been from Littlerock in Los Angeles County.

All three of the victims had to be transported to the UC Davis Medical Center. An investigation into the Zamora truck accident remains ongoing at this time.

Liability In Box Truck Accidents

Fatal truck accidents have increased in frequency from a low point in 2009. According to one study from the FMCSA, “In 2017, 4,889 large trucks and buses were involved in fatal crashes, a 9-percent increase from 2016. Although the number of large trucks and buses in fatal crashes has increased by 42 percent from its low of 3,432 in 2009, the 2017 number is still 7 percent lower than the 21st-century peak of 5,231 in 2005.” There are a number of factors associated with fatal truck accidents including:

  • Brake problems
  • Driver illness
  • Prescription drug use
  • Tire problems
  • Traveling too fast for conditions
  • Unfamiliarity with roadway
  • Roadway problems
  • Over-the-counter drug use
  • Inadequate surveillance
  • Fatigue

A number of truck accidents are caused when truck drivers leave a freeway shoulder and make dangerous merges into traffic. Truck drivers are supposed to yield the right of way to any vehicle close enough to pose a hazard before merging. According to California Vehicle code 21658, “A vehicle shall be driven as nearly as practical entirely within a single lane and shall not be moved from the lane until such movement can be made with reasonable safety.” Victims of semi-truck accidents often suffer from a wide variety of injuries including:

  • Lacerations and bruises
  • Seat belt injuries
  • Broken bones
  • Head trauma
  • Spinal cord injuries
  • Psychological injuries
  • Wrongful death

The family of any victim that died in a truck accident may have legal recourse through California Code of Civil Procedure 377.60. Damages in a civil claim can help cover funeral expenses, lost wages, medical bills and pain and suffering. Unfortunately, truck companies will often fight hard to deny liability for an accident. A truck accident attorney can investigate the facts of your case free of cost and make sure that crucial pieces of evidence are being preserved.
