Jorge Vasquez Rainbow (Silvia Campos, Silvana Injured): Jorge Vazquez Died In Rainbow Truck Accident By The Intersection Of Rainbow Valley Boulevard and Old Highway 395
RAINBOW, CALIFORNIA (July 25, 2019) – A 13-year-old boy identified as Jorge Vazquez was killed in a car accident with a semi-truck carrying two rock hauling trailers near the intersection of Rainbow Valley Boulevard and Old Highway 395.
Jorge Vazquez was in the car with his mother and younger sister when the accident took place. The semi-truck collided with the Honda Pilot carrying the family as one of the vehicles was turning onto Rainbow Valley Boulevard.
Jorge Vazquez was riding in the front seat and took the worst part of the impact. The rock hauler truck pushed the Honda Pilot into a light before it came to a stop.
Jorge Vazquez was pronounced dead due to his injuries. His mother and sister Silvia Campos and Silvana both had to be rushed to the hospital with major injuries. A Go Fund Me page has been set up in order to help the family affected by this accident.
The collision left the community in Rainbow outraged. Residents have been warning city officials for years that Rainbow Valley Boulevard and Old Highway 395 is a dangerous intersection. But nothing has been done.
There is a two way stop at the intersection, but it can be extremely dangerous to drive through or to turn onto Old Highway 395. Residents have proposed putting a light at the intersection. After the fatal truck accident that killed Jorge Vazquez city officials have said that they will begin studying the intersection to determine if anything can be done.
Preventing Accidents At Intersections
Cities need to make sure that their roads are updated from time to time to make sure that they are safe. As a city or community grows an intersection may become progressively more dangerous over time. Roads with heavy traffic and cross traffic should typically be covered by a light. There are a number of other engineering measures that a municipality can take in order to prevent accidents:
- Connected traffic safety lights
- Pedestrian head starts
- Protected left turns
- Raised crossings and intersections
- Protected intersections
Intersections can be dangerous if they have a poor line of sight. An intersection’s sight distance is “the distance a motorist can see approaching vehicles before their line of sight is blocked by an obstruction near the intersection.” This can be caused by faulty engineering, trees or structures. Depending on the facts of any case, there may be numerous sources of liability for a truck accident.
Liability In Truck Accidents
Truck drivers are supposed to maintain a safe speed and keep an eye out for other vehicles. A number of federal and state laws limit truck drivers to 55 mph. If they exceed this speed the may face some liability for an accident. But no matter how safe a truck driver is accidents can still occur because a road is dangerous.
A city may face civil liability for an accident if it was caused by a lack of adequate signs. According to California Government Code 830.8, “A public entity may be liable for accidents approximately caused by its failure to provide a signal, sign, marking or device to warn of a dangerous condition which endangers the safe movement of traffic and which would not be reasonably apparent to, and would not have been anticipated by, a person exercising due care.”
The family of any person that died in a truck accident may have recourse through California Code of Civil Procedure 377.60. Damages can help cover all of a victim’s medical bills, funeral expenses, lost wages and emotional trauma. It’s always a good idea to have your case examined by an experienced truck accident attorney. An attorney can examine an intersection free of cost and let you know if a city was negligent in its construction or maintenance. There are, however, very strict statute of limitations associated with pursuing a municipal negligence claim. Failure to act withing the statute of limitations may result in a permanent forfeiture of your rights.
