WESTMINSTER, CALIFORNIA (January 9, 2018) – A 40-year-old man from Stanton identified as Jeffrey Isaacson has died after being involved in a motorcycle accident with a Westminster garbage truck Wednesday.

Westminster police told investigators the motorcycle crash took place around 7: 21 a.m. The driver of the garbage truck remained at the scene and cooperated with investigators.

It remains unclear if any charges will be filed following the deadly garbage truck accident that killed Jeffrey Isaacson. A number of people took to social media to express their condolences and shock following the accident.

Franklin Sterns posted the following message to Facebook:

“Oh my gosh Jeffrey Isaacson. We had fun together. I was thinking of you today and your toxic waste room at SpookyHouse. And your travel channel commercials, and popping out of a casket on national TV 📺.

You Rocked our family’s world at DisneyLand with the tour behind the scenes and the Lincoln Train 🚂. And all your character voices. You are too young, starting new chapter in your life, bringing up a family in a new state.

I want to wake up and see you do a “pop” scare. Hoping this is just an internet hoax. I was all ready to send you Birthday Greetings in a few days. I am sad and in shock.
Love and Rest In Peace.
Franklin Sterns, and family.”

Liability In Motorcycle Accidents Involving Garbage Trucks

Garbage truck operators are held to a very high standard when it comes to driving safely. A fully loaded garbage truck can weigh 35 tons and cause serious injuries or death in an accident. Moreover, if a garbage truck operator is negligent and causes an accident the company that they work for may be held vicariously liable. The concept of vicarious liability is crucial in personal injury law. In short, companies are generally responsible for the negligence of their employees when those workers are operating within the course and scope of their employment.

In addition to driver error, there are a number of systemic safety problems with private garbage truck companies. For example, in New York within the period of 1 week 142 private garbage trucks had to be taken off the road for “malfunctioning brakes, faulty steering columns and low tire pressure,” according to the New York Post. Maintaining garbage trucks can be expensive and a number of companies get into trouble when they try to cut corners.

Even if a motorcyclist is partially at fault in an accident, this will not prevent them from being able to file a claim. California is a comparative fault state. A plaintiff’s damages are simply reduced proportionally with the percentage that they are deemed to be at fault. A truck accident attorney can evaluate all of the specific facts of your case and let you know if you have a claim that can be pursued. There are statute of limitations associated with being able to file a claim. Acting quickly to preserve your rights is therefore important.
