RANCHO MIRAGE, CALIFORNIA (April 16, 2019) – A 77-year-old bicyclist identified as Jack Peterson was killed in a car accident near the intersection of Bob Hope Drive and Casino Way.

California Highway Patrol are saying that the accident took place around 1:30 p.m. He had to be transported to a local area hospital with major injurious.

A picture of the accident scene shows a Mercedes with a cracked windshield and a broken taillight. The car was traveling northbound at the time of the crash and Jack Peterson was traveling eastbound on the crosswalk.

Neither drugs nor alcohol are believed to have played a role in the crash.

Liability In Bicycle Accidents

Every year around 4,000 pedestrians are killed in pedestrian accidents. Bicyclists are particularly at risk. A number of drivers simply aren’t paying attention. This is especially problematic at intersection when drivers are making left-hand turns.

According to the California Vehicle Code 21801, “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.”

Depending on the facts of any case there may be multiple sources of liability for a bicycle accident. Of course, a driver could be held liable following an accident. The vast majority of accidents are caused by driver error. Fatigue, speeding and drug use are all too common in fatal accidents. A city may face civil liability as well for a dangerous condition on public property. Cities have a legal responsibility to design, construct and maintain roads that are reasonably safe. A wrongful death attorney can examine all of the facts of your case and let you know what your options are.
