Liability In Madera County Semi-Truck Accidents
There are a number of laws designed to protect workers and their families when they are injured on the job. Many truck drivers are independent contractors, but some are also employees. According to the California Department of Industrial Relations Workers Compensation Guidebook, “If you get hurt on the job, your employer is required by law to pay for workers’ compensation benefits.” Workers are afforded a number of protections and benefits through the worker’s compensation system including:
- Medical Care: Worker’s are entitled to receive medical care including costs for treatment services, tests, medicine, equipment and travel costs to treat the injury.
- Temporary Disability Benefits: This can include payments fro missed work as a result of a work injury.
- Permanent Disability Benefits: Some workers are so seriously injured that they cannot return to work.
- Death Benefits: In the event that a worker dies, payments can be made to their spouse, children or other dependents.
What many workers may not realize is that the worker’s compensation system may not be their only recourse after an accident. Depending on the facts of any case, an injured worker or their family may be entitled to additional aid through a third party liability claim. If, for example, a driver pulled out in front of a truck thereby causing an accident they or the company that they work for may face vicarious liability. Companies are generally responsible for the negligent conduct of their employees – insofar as those employees were working within the course and scope of their job duties.
The family of any victim that died due to the negligence of another driver may have legal recourse through California Code of Civil Procedure 377.60. This statute affords families additional protections and benefits not covered through workers compensation. Damages in a civil claim can further help with lost wages, medical bills, funeral expenses and pain and suffering. A truck accident attorney can examine all of the facts of your case free of cost and let you know what your legal options are.
