Gloria Ayala Santa Barbara: Gloria Bravo De Ayala Injured In Santa Barbara MTD Bus Accident That Killed Eve Debra Johnson By Figueroa Street near Chapala Street

SANTA BARBARA, CALIFORNIA (October 10, 2019) – One woman identified as Gloria Bravo De Ayala was injured and Eve Debra Johnson was killed in an MTD bus accident near Chapala Street and West Figueroa Street.

Santa Barbara police are saying that the accident took place around 2:30 p.m. For reasons that remain under investigation an MTD bus drove onto the sidewalk while making a right turn.

The MTD bus kept going forward until it hit a bench where several victims were sitting including Gloria Bravo De Ayala. The bus eventually came to a stop in a city parking lot.

Paramedics were called to the scene in order to help all of the victims including several people on the bus who were injured.  Gloria Bravo De Ayala was taken to the hospital.

Despite life-saving measures Eve Debra Johnson later died due to her injuries. The MTD bus had to be towed away so that it could be examined.

Police remained at the scene for some time and spoke with over 20 witnesses in order to determine what went wrong.

Liability In MTD Bus Accidents

Bus drivers have a heavy responsibility to drive their vehicle safely. Bus companies – both private and public – are considered common carriers under the law and are held to a high standard. According to the Judicial Council of California Civil Jury Instructions, “Common carriers must carry passengers [or property] safely. Common carriers must use the highest care and the vigilance of a very cautious person. They must do all that human care, vigilance, and foresight reasonably can do under the circumstances to avoid harm to passengers[or property].” There are a number of factors commonly associated with bus accidents:

  • Brake problems
  • Traffic flow interruption (congestion, previous crash)
  • Prescription drug use
  • Traveling too fast for conditions
  • Unfamiliarity with roadway
  • Over-the-counter drug use
  • Roadway problems
  • Made illegal maneuver
  • Fatigue

When a pedestrian is injured in an accident the bus company that hired the negligent employee may be liable. Under the legal doctrine of respondeat superior employers are generally responsible for the negligent conduct of their employees – insofar as those employees were working within the course and scope of their job duties. Different jurisdictions will use one of the following tests to determine whether vicarious liability will apply:

  1. Benefits Test: Courts will look to determine if an employee’s actions were endorsed by the expressed or implied permission of the employer and are conceivably of some benefit to the employer.
  2. Characteristics Test: Courts will look to determine if an employees action is common enough for that job so that it could fairly be deemed to be characteristic of the job.

Liability for a bus accident may extend beyond the bus driver or company responsible for the bus. For example, a bus manufacturer may be liable for a bus accident if it was caused by a defect within the bus. A number of accidents occur every year when bus accelerators get stuck or when the breaks on a bus fail. It’s important that evidence is preserved after an accident.

Any person that is injured in a bus accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Based on federal regulation from the FMCSA buses that carry 16 or more passengers must carry at least $5,000,000 worth of liability coverage. Unfortunately, bus companies will often fight hard to deny liability for an accident. A bus accident attorney can examine all of the facts of your case and let you know what your legal options are.
