Truck Accident Statistics and Causes
According to the FMCSA, around 4,500 people are killed every year in truck accidents. Those that manage to survive are often left with long lasting and serious injuries. There are hundreds of potential factors causing a truck accident , but what follows are the top tend reasons accidents occur in ascending order:
- Inadequate surveillance
- Over-the-counter drug use
- Stopping before crash
- Roadway defects
- Unfamiliarity with roadway
- Prescription drug use
- Traffic flow problems
- Brake issues
There are a number of state as well as federal safety regulations for trucking companies designed to help prevent accidents. Title 49 of the Code of Federal Regulations contains most of the federal statutes trucking companies must abide by. Truck drivers must follow these regulations in order to be safe:
- Commercial Driver’s License: All truck drivers that operate 18-wheelers must have a commercial driver’s license. Failure to have the proper license is a major infraction.
- Rest: Fatigue is the number one factor in fatal truck collisions. Truck drivers must be given adequate break and rest periods and document their hours. Truck drivers aren’t supposed to drive past their allotted schedule.
- Maximum Weight Limit: Different types of trucks have different weight limits. Most single-axle trucks can carry a max payload of 20,000 lbs. Carrying cargo in excess of a truck’s weight limit is dangerous as it can put undo stress on the engine and make brake failure more likely.
- Quality Control: Trucks should undergo periodic maintenance in order to make sure that all of it’s parts are in working order. A tire blowout or brake failure can have catastrophic consequences. With regular maintenance a large number of accidents can be prevented.
Failure to adhere to these regulations can result in accidents which cause serious injury or death. Depending on a number of factors, there are multiple entities that could face liability in the event of a truck crash.
Liability In Truck Accidents
Trucking companies are considered “common carriers” under the law. Their drivers are expected to use a high degree of vigilance in order to prevent accidents. According to Squaw Valley Ski Corporation v. Superior Court, “The elevated standard of care for common carriers is “based on a recognition that the privilege of serving the public as a common carrier necessarily entails great responsibility, requiring common carriers to exercise a high duty of care towards their customers.”
When a truck driver is negligent and causes an accident the company that they work for may face liability as well. Based on the legal doctrine of Respondeat Superior, employer’s are generally responsible for the wrongful acts of their employees. This is typically the case insofar as the negligent employee was working within course and scope of his/her job duties. Liability in truck accidents may often extend beyond faulty drivers.
A city may face liability for a bicycle accident if it was caused by a dangerous condition on public property. According to California Government Code 835, “Except as provided by statute, a public entity is liable for injuries caused by a dangerous condition of its property if the plaintiff establishes that the property was in a dangerous condition at the time of the injury, that the injury was proximately caused by the dangerous condition, that the dangerous condition created a reasonably foreseeable risk of the kind of injury which was incurred” For example, a road may be in a dangerous condition if it lacks stop signs or other essential safety features necessary to prevent accidents.
When there is a history of accidents at a particular intersection this puts a city on notice that there is a dangerous condition that needs to be corrected. A truck accident attorney can examine all of the facts of your case and let you know what your options are. Victims of truck accidents are able to recover damages through a bodily injury claim. Damages can include financial compensation for lost wages, medical bills and pain and suffering. It doesn’t cost anything to hire an attorney and they can begin taking steps to make sure that your rights are being protected.
