Liability In Motorcycle Accidents
All drivers have a legal responsibility to operate their vehicles in a reasonably safe manner and take steps to avoid causing accidents. It is illegal to cross a double yellow line and drivers that do are likely to be found at fault in the event of an accident. According to California Vehicle Code 21460, “If double parallel solid yellow lines are in place, a person driving a vehicle shall not drive to the left of the lines, except as permitted in this section.” There are a number of reasons why a drive may cross a double yellow line:
- They may have been distracted
- They may have been intoxicated
- They may have been fatigued
- They may have been unfamiliar with the road
- They may have been trying to pass another vehicle
Motorcycles are by their very nature less crass-worthy than other vehicles. Riders are much more likely to be catastrophically injured or killed. Injuries from a motorcycle accident may include:
- Broken bones
- Back injuries
- Spinal injuries
- Abdominal injuries
- Muscle injuries
Many of the injuries associated with motorcycle accidents can be psychological. Victims might suffer from PTSD and and recurring thoughts about the event. Any person that is injured in a motorcycle accident could potentially recover damages for lost wages, medical bills and pain and suffering. A motorcycle accident attorney can examine all of the facts of your case and let you know what your options are.
